TERMS
Terms and conditions
What applies when you use this website, and how a contract for electrical work is formed.
1. Scope of these terms
These terms govern the use of the website at https://karenelektroservice.de/. They do not govern the electrical work itself. Work is carried out under the conditions agreed individually for each job, together with the applicable statutory provisions.
2. No contract is concluded through the website
The website provides information only. It has no shop, no booking system, no online payment and no contact form. Viewing a page, clicking a phone link or clicking an email link does not create a contract, a reservation or an obligation on either side, and it is no assurance that a particular service is available at a particular time.
3. How a contract for work is formed
A contract is formed only where the business and the customer expressly agree the scope, the date and the price, by telephone, by email or in writing. Verbal or written quotations that have not been accepted create no obligation. Urgent faults can also be discussed by phone; whether a call-out takes place is agreed in that conversation.
4. Prices
No prices, price lists or flat rates are published on this website. Where a price is quoted, it is stated individually and includes statutory value added tax where that tax applies, in line with the German Price Indication Ordinance. Material, travel and any additional work are identified separately.
5. Right of withdrawal
Because no contract is concluded through the website, the distance-selling rules are not triggered by the website itself. Contracts concluded away from business premises, or by telephone or email, can nevertheless carry a statutory fourteen-day right of withdrawal under Sections 312g and 355 of the German Civil Code, unless a statutory exception applies. One exception is particularly relevant to this trade: under Section 312g(2) No. 11 BGB, urgent repair or maintenance work that the consumer has expressly requested by asking for a visit is excluded. Where a right of withdrawal exists, the customer must receive a correct withdrawal instruction and the model withdrawal form; if that instruction is missing or defective, the period does not start to run and the right may persist for up to twelve months and fourteen days. The wording used for the individual job must be settled before it is relied upon. See the note at the foot of this page.
6. Refunds and returns
The website sells no goods and takes no online payments, so there is no online refund or return process to describe. Money already paid is dealt with under the contract for the individual job and the statutory rules on defective work. Where a valid withdrawal applies, amounts paid are repaid under Section 357 BGB, and the customer may owe compensation for work already carried out under Section 357a BGB.
7. Warranty and liability
The statutory provisions apply to defects in work carried out and to liability. This website does not restrict or exclude any statutory right, and in particular does not restrict liability for injury to life, body or health or liability under mandatory statutory provisions.
8. Content of the website
The content is provided for general information and describes the services offered. It is not technical or legal advice for an individual installation, and it does not replace an on-site assessment. Sections 7 to 10 of the German Digital Services Act govern responsibility for the website’s own and for third-party content.
9. Copyright
The text, layout, inline icons and the schematic drawing on the homepage of this website were created for this business. Third-party content is used only where a licence permits it. Reproducing any part of the website requires the prior written consent of the provider, except for uses permitted by law.
10. Consumer dispute resolution
The statement required by Section 36 of the German Consumer Dispute Resolution Act depends on the actual circumstances of the business and is to be completed before publication. The European online dispute resolution platform is provided by the European Commission.
11. Applicable law
German law applies to the use of this website. For consumers, the mandatory consumer-protection provisions of the country of habitual residence remain unaffected where they are more favourable.
This is an English translation for convenience. The German version is the authoritative version. Sections 5, 6 and 10 describe general statutory positions and must be settled with a lawyer before publication; see docs/legal-review.md.
